CMS has recently published a proposed rule for Stage 3 of meaningful use which focuses on the advanced use of EHR technology to promote health information exchange and improved outcomes for patients.

Eligible professionals participate in the program on the calendar years, while eligible hospitals and CAHs participate according to the Federal fiscal year.

The impact that the transparency imposed by this law will have on investments by California Plans remains to be seen.

The legislative history includes the concern that the disclosure requirements may result in the exclusion of California Plans from certain private funds or may hamper a California Plan’s ability to negotiate lower fees in such investments.

The intent of this amendment, which is set forth in Assembly Bill 2833 (“AB 2833”), [1] is to create greater transparency into the fees and expenses that California Plans pay with respect to their investments in private funds.

AB 2833 coincides with the Securities and Exchange Commission’s focus on fee and expense disclosure by private equity funds and recent enforcement actions regarding such disclosure.The term does not include a medical device that is surgically implanted, or the replacement of such device. The definition of an assistive technology device is very broad and gives IEP teams the flexibility that they need to make decisions about appropriate assistive technology devices for individual students.Assistive technology includes technology solutions that are generally considered instructional technology tools, if they have been identified as educationally necessary and documented in the student’s IEP.There are mandatory safety belt laws in all states except New Hampshire.In some states, these laws cover front-seat occupants only, but belt laws in 29 states and the District of Columbia cover all rear-seat occupants, too.The Individuals with Disabilities Education Act (IDEA) mandates the school system’s responsibility to provide assistive technology devices and services to students with disabilities. 1401(1)) Although the IDEA uses the term “device”, it is important to recognize that assistive technology devices required by students with disabilities include hardware and software as well as stand-alone devices.
